Georgia Registered Agent LLC and its affiliates (collectively, “Georgia Registered Agent LLC” “we,” “us,” or “our”) are committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information in compliance with applicable U.S. state comprehensive consumer privacy laws. This policy applies to all of the interactions we may have with you including your use of our website(s), telephone calls, email exchanges, etc. Because this Privacy Policy is part of our Terms of Service, it governs your use of our services and products (“Services”) and, by using our Services, you accept the terms of this Privacy Policy. As a general practice, we never sell personal information or data to marketing firms, and we limit data sharing to purposes related to providing our Services and fulfilling our legal obligations.

We strive to collect only the minimum amount of information about you necessary to provide excellent service and user experiences. If you hire us for any service, we will try to list our address wherever possible, so you don’t have to list your address on public documents. While there are always risks with transmitting any data via the Internet, we want you to know our staff is continuously working on website and client account security to protect any information shared with us.

We try extremely hard to provide all our services internally so we can avoid sharing your information with third parties. But the use of services like credit card processors is currently unavoidable. However, we do not, and will not, allow the information shared with these parties about you to be used by them to independently market to you. We know any person who uses this website or our services is inherently trusting us with their data. While we as a company are proud of our privacy policy and the attention given to protecting user data, we also want to honor the trust our users place in us with complete transparency.

Our security is built to protect data from unauthorized access, theft, or loss while still prioritizing availability to ensure that systems and data are accessible when needed through the processing of data accurately and completely. We also place an emphasis on confidentiality by limiting access to data based on authorized roles allowing us to protect client privacy through the safeguarding of individuals’ personal information.

This policy does not apply to publicly available information (e.g., government filings we process as a registered agent) or de-identified/aggregated data. We do not sell or share your personal information for cross-context behavioral advertising, targeted advertising, or profiling in furtherance of decisions.

1. What Personal Information Do We Collect?

We collect only the minimum necessary Personal Information (“PI”) to provide services, fulfill legal obligations, and improve our offerings. At the point of collection we disclose categories collected, purposes, and rights. The types of information we may collect about you include:

  • Identifiers/Identifying Information: To provide outstanding services and receive payment for those services, we often are required to capture information such as name, address, telephone number, email address, credit card and debit card information, social security number, Federal Tax Identification number, Internet Protocol address (“IP address”) and other online identifiers.
  • Business Information: To help start and maintain your business, we may need to collect information such as legal entity name, business entity or filing, officers, directors, managers or members of an entity, communications contact, business type, merchant category, other business related information, services purchased, and other purchasing or consuming histories or tendencies.
  • Internet/Usage Data/Internet Information: We may collect information about visitors to our website such as browser settings, operating systems, referring/exit pages and clickstream data.
  • Sensitive PI: SSN, financial account logins, precise geo-location (if used for services), communications content (if used with or for services).
  • Audio/Communications/Audio Information: If you call us or exchange emails with our customer service representatives, we may record the phone call or retain the email string to help improve our training and services.

Sources: Directly from you (forms/calls; you are the primary source of information that we collect. When you complete a form online, send us an email, or speak to us on the phone, you are providing us information about you); indirectly (cookies, if enabled); affiliates/partners; service providers (e.g., payment processors); public records (e.g., state databases).

We do not collect PI from children under 13. Our Services are not intended for use by children under the age of 13 and we do not knowingly collect personal information from children under 13. If you are under the age of 13, please leave our website and go outside and play. For individuals 13-17, we require parental consent to provide any of our Services.

2. How Do We Use Your Personal Information?

Uses are limited to legitimate purposes. In general, we use the information we collect about you to provide the best business formation and maintenance services we can. We also use that information to help us personalize and improve your experience with our website. We may also use the information in the following ways:

  • Provide/maintain services (e.g., entity formation, registered agent duties; the information you provide us when you sign up for services is the same information we use to fulfill those services). We may also use your information to optimize or improve our Services and operations.
  • Process payments/communications (e.g., emails, calls).
  • Legal/compliance (e.g., fraud detection, subpoenas, fulfilling legal and compliance obligations). We may also collect information for the purpose of detecting fraud or other suspicious activity.
  • Analytics/improvement (e.g., site optimization; performing analytics).

We already limit the use of any Sensitive Personal Information (“Sensitive PI”) we gather from you to that which is necessary to perform the services and/or goods you hired us to perform. You may request us to “Limit the use of Sensitive Personal Information.” Sensitive PI includes: a social security number, account log in information, financial information, specific geo-location, racial or ethnic origin, religious beliefs, sexual orientation, health information, bio-metrics, and the contents of communications to us. This is not an absolute right, and we may decline to limit the use of Sensitive PI under a qualifying exemption.

3. How Do We Disclose Your Personal Information?

Disclosures are minimized and only to:

  • Service Providers: We may share personal information with agents, affiliates, partners, professionals or other third parties that perform functions on our behalf, such as analytics, credit card processing, attorney-assisted products, etc. These are the services we can’t provide internally. These entities have access to the personal information needed to perform their functions and are obligated to maintain the confidentiality and security of that personal information. Service providers are not authorized to use the information we share with them for any purpose other than providing services to us or to you.
  • Legal/Government: We may disclose information as required by law, such as in response to a subpoena, a lawful request by a public authority. Certain Personal Information may become public record when documents are filed with the federal or state government, or with a court. This Privacy Policy does not cover these or similar third-party actions.
  • Mergers: Successors (with notice).

Except as disclosed in this Privacy Policy, we do not disclose personal information to any companies not part of Georgia Registered Agent LLC, its parent, subsidiaries, affiliates, business partners, or related entities. Although, as discussed below, we may provide some personal information to certain service providers and other third parties, in no event will we sell your personal information as part of a customer list or similar transaction for unrelated parties to independently market to you. We do not, and will not, sell or share your information to third parties. WE DO NOT share your personal information that is intended to or result in targeted advertising.

4. Cookies and Tracking Technologies

We use cookies and similar technologies (e.g., web beacons/clear gifs) to personalize your experience, analyze usage, and manage content (per all states; no dark patterns in consents).

  • Essential Cookies: For site functionality.
  • Analytics/Advertising: Meta Pixel for site usage. Our website uses “cookies” to help personalize your online experience. A cookie is a text file that is placed on your device by a web server. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. If you register an account with us, a cookie allows us to recall your specific information on subsequent visits. This facilitates the process of recalling your personal information so that when you return to our website, the information you previously provided can be easily retrieved. Our website uses Meta Pixel for analytics and advertising purposes. When you visit our website, Meta Pixel may automatically collect information such as your IP address, browser type, browsing behavior, and interactions with our website. This information helps us understand how visitors use our services and allows us to provide more relevant advertising. You can manage the use of Meta Pixel at any time through our cookie banner or privacy settings. If you choose to decline cookies, Meta Pixel and similar tracking technologies will be disabled. We also employ a technology called web beacons or “clear gifs” that help us track referrals from our partners and affiliates and better manage content on our website. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track online movements of web users. Our partners and affiliates may use cookies and web beacons to collect information about your activities on our site. The use of tracing technologies by our service providers, technology providers or other third parties is not covered by our Privacy Policy.

5. Your Privacy Rights

You have a right to:

  • Access/Know: You have the right to request copies of your personal data (e.g. categories/sources/purposes of PI collected in last 12 months).
  • Correct: You have the right to request that any information you believe is incomplete or inaccurate to be corrected.
  • Delete: Request deletion, exemptions may apply.
  • Opt-Out/Limit Sensitive PI: Request stopping or limit the use of PI and Sensitive PI.
  • Portability: Receive data in structured or portable format.
  • Contest/Appeal: In Texas, you have the right to appeal our denial of a request. If we reject your appeal, you may contact the Attorney General.
  • Non-Discrimination: If you exercise your rights under an applicable privacy act, we will not provide discriminatory treatment to you.

Minors: Our Services are not intended for use by children and or minors under the age of 13 and we do not knowingly collect personal information from children under 13. If you are under the age of 13, please leave our website and go outside and play.

After you submit the request, you will be asked to verify your email address and you may also be asked to provide additional information in order to verify your identity. We will attempt to verify your identity by asking for information that matches the information that we have previously collected about you. Where this is not possible, we may request that you submit additional documentation for verification. Please note that, in accordance with the CCPA, CPRA and or TDPSA we will not be able to satisfy your request until we have verified your identity.

You may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request, you must provide us with your written permission for the agent to make the request on your behalf, or provide us with a signed power of attorney. We will also need to verify valid government issued identification for both you and the agent.

6. Data Protection Assessments

We conduct and retain Data Processing Agreements (“DPA”) before high-risk processing, documenting risks, mitigation, and benefits.

7. Security and Retention

  • Security: We strive to protect your personal information and data. Here’s how we try to do that: Personal information collected by the site is stored in operating environments that are not available to the public. We request proof of identity before we disclosing your personal information. We ask for certain client identifiers or other information in order to verify your identity before conducting the transactions you have requested. Please understand that while we try our best to safeguard your personal information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. That’s why we review and update our security procedures, technology, and methods to secure information.
  • Retention: At a minimum, we will retain your PI and Sensitive PI for as long as needed to provide you Services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may maintain some or all of this information in our archives even after it has been removed from the site. After any such service is concluded, any such information collected will be retained for the maximum amount allowed by law and/or subject to exemptions under applicable privacy acts.
